CPS Drop Careless Driving and Fail to Stop – Driver Pleads to Speeding at 104mph – Keeps Licence.

This driver, represented by barrister Harry Bowyer, was stopped by police on the A1 having been clocked at 104 mph. The officer was particularly zealous and reported the driver for careless driving and failing to stop on the same evidence. He also impounded the driver’s car!

When we got the video it was quite apparent that the careless driving was based on speed alone and the driver pulled into the second possible stopping space which made the fail to stop charge somewhat ridiculous.

In this case the CPS were utterly reasonable and dropped the careless driving and the fail to stop and prosecuted the speeding on the facts as disclosed by the video. The driver was dealt with by way of a fine and penalty points.
