Drink Drive Prosecution Withdrawn – Post Driving Consumption

Our Motoring Solicitor Laura Newton was instructed to act for a driver who was charged with a drink drive offence. His vehicle had been found abandoned following an accident on an icy country lane. There were no other vehicles or people involved. Police traced the registered keeper of the vehicle and attended at his address in the early hours of the morning. The driver failed a breath test. Prior to the first Court hearing, we were able to instruct a forensic expert to prepare a report to show that the alcohol in the driver’s system was consumed after the accident occurred and not prior to driving the vehicle. The prosecution accepted the evidence and withdrew the charge without the driver having to attend Court. His legal costs and costs of the forensic expert were reimbursed in full under a Defence Costs Order.
